Report on Ordinance No. 10 of 1909.
I have examined the accompanying Ordinance, entitled "An Ordinance to amend the Code of Civil Procedure" and I am of opinion that the Ordinance is one which is not contrary to the Governor's Instructions.
This Ordinance prescribes the procedure to be adopted with regard to the execution of Commissions Rogatoire or Letters of Request. The object is to make the procedure in this Colony uniform with that in force in other parts of the Empire.
This Ordinance also amends section 569 of the Code of Civil Procedure by the addition thereto of sub-sections (3) and (4) providing for the payment of the cost of subsistence of persons imprisoned on mesne process.
